RERA Complaint

A formal complaint filed by a buyer against a builder on the state RERA portal for violations such as delayed possession, specification changes, non-disclosure, or fund diversion.

What is a RERA Complaint?

A RERA complaint is a formal grievance filed by a homebuyer against a developer through the state RERA authority online portal. Under Section 31 of the RERA Act, any aggrieved person may file a complaint for violations including: delayed possession, changes to specifications without consent, failure to disclose material information, non-maintenance of escrow account, and misrepresentation in marketing materials.

Grounds for Filing

  • Delayed possession: Builder fails to hand over the unit by the RERA-registered completion date without buyer consent for extension
  • Specification changes: Builder substitutes materials, fixtures, or layout without written buyer consent — a RERA violation under Section 14
  • Non-disclosure: Builder concealed material facts at time of booking such as pending litigations, land disputes, or encumbrances
  • Refund denial: Buyer wishes to exit for valid reasons and builder refuses
  • Common area deficiencies: Amenities promised at booking not delivered at possession

How to File a RERA Complaint

  1. Gather documents: RERA registration number, allotment letter, sale agreement, payment receipts, all written communications with the builder
  2. Register on the state RERA portal as a complainant
  3. File complaint under the relevant section (Section 18 for refund, Section 31 for general violations)
  4. Pay the filing fee — typically Rs 1,000 to Rs 5,000 depending on the state
  5. Serve notice to the builder through the portal
  6. Attend hearings — typically 2 to 4 hearings over 3 to 6 months

Resolution Timeline

RERA mandates resolution within 60 days of filing. In practice: Karnataka RERA averages 3–4 months, Maharashtra RERA 4–6 months, UP-RERA 6–12 months due to caseload. Refund orders are common where the builder has clearly missed the registered completion date. Execution of orders may require approaching the RERA Appellate Tribunal.
